Data protection is a fundamental right guaranteed under constitutional law. When sending application documents, sensitive data will be disclosed. Applicants should therefore be kept well informed about its collection and usage, as well as the protective measures being applied. As the data controller under data protection law, bet-at-home.com Entertainment GmbH, Hafenstraße 47-51, 4020 Linz, Austria (referred to as bet-at-home hereafter), undertakes to protect the personal data of applicants. bet-at-home shall only process this data if such data processing is permitted by law. In the following, bet-at-home shall explain all of the important information pertaining to the handling of the data of applicants within the company:

1. Collection of Personal Information

For the purpose of completing the application and selection process, the processing of the applicant’s personal data, including their name, address, phone number, date of birth and other data stated in the application form, is required as part of steps prior to entering into a contract pursuant to Article 6(1) point b of the GDPR (General Data Protection Regulation). If this data is not provided, the conclusion of a contract is not possible.
bet-at-home processes all of the data submitted by the applicant in the application form and all of the data provided by the applicant in their application documents, even if this concerns data as defined in Article 9 of the GDPR (data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, genetic data, biometric data for uniquely identifying a natural person, health data or data concerning sex life or sexual orientation of a natural person). Not providing data as defined in Article 9 of the GDPR does not have any influence on the application and selection process. Data as defined in Article 9 of the GDPR is, thus, provided freely by the applicant. The applicant confirms that they are aware of this and, by providing data as defined in Article 9 of the GDPR in the application form or in their application documents, gives their explicit consent to further processing of their data pursuant to Article 9(2) point a of the GDPR.
When registering, the applicant can import their data directly from a secure online source (XING, LinkedIn) into the application form. In the process of doing this, the applicant will be transferred to the homepage of the selected online source and prompted to log in if they are not already logged in. Subsequently, the applicant will be informed by the selected source what data is to be transferred to bet-at-home. Once the applicant has confirmed their acceptance of this, the data will be transferred to bet-at-home. During this process, bet-at-home only stores data which is required for the application form. The applicant can alter the imported data at any time. Using XING or LinkedIn to complete the application form provides bet-at-home with access to the applicant’s data as stated on the chosen website. Information concerning the exact purpose and extent of the data collection as well as the further processing and usage of the data and the rights and settings options hereof for privacy protection can be found in the respective Privacy Policies of XING and LinkedIn.
If a suitable applicant provides the mentioned data to a personnel consultant or headhunter, this data can be transferred to us on the basis of our contractual agreement with the personnel consultant or headhunter.
During the process of selecting suitable applicants, references who are derived from the application documents may be contacted. bet-at-home is allowed to do this under Article 6(1) point f of the GDPR. The legitimate interest is the employer’s corporate due diligence and duty of care.
Publicly accessible information may be checked as well. bet-at-home is allowed to do this under Article 6(1) point f and Article 9(2) point. e of the GDPR. The legitimate interest is again the employer’s corporate due diligence and duty of care.
bet-at-home points out that visitor registration takes place during job interviews at the Linz location and video surveillance is used. Further information is provided in detailed notices on site.
Due to legal provisions, proof of a low epidemiological risk (proof of vaccination, recovery or test) may be requested and checked during job interviews. If the applicant is exempt from requirements relating to COVID-19, medical certificates need to be provided as proof. bet-at-home requires this information for the purpose of risk assessment and planning regarding appropriate measures and rooms. Data concerning a low epidemiological risk is collected based on the guidance for public health pursuant to Article 9(2) point b, point h and point i of the GDPR in conjunction with the current regulations for COVID-19 measures. If no legal provisions requiring proof of a low epidemiological risk exist, information about the COVID-19 vaccination status is provided freely and only if the applicant has given their explicit consent to it pursuant to Article 9(2) point a of the GDPR. In this case, not providing information does not have any influence on the application and selection process.

2. Retention period

If the applicant is applying for a specific job offer or making a speculative application, bet-at-home shall process this data during the entire duration of the application and selection process. All data collected concerning the applicant will be deleted 6 months after the conclusion of the application and selection process. Furthermore, the data shall be used for the “talent pool”, a database managed by bet-at-home made up of applicant data, and stored in bet-at-home’s database for up to 3 years, provided that the applicant (upon request) gives their (explicit) consent to it pursuant to Article 6(1) point a and Article 9(2) point a of the GDPR. During this time, bet-at-home may find a suitable position for the applicant.
If the applicant is hired, their data will be stored and processed as employee data.

3. Disclosure of your Data

bet-at-home provides the applicant’s personal data to the employed data processing company rexx system GmbH, Süderstraße 75-79, 20097 Hamburg, Germany, for the electronic processing of applications.
In individual cases, the applicant’s personal data is submitted to other companies included in the corporate group for the purpose of processing their application, provided that the applicant (upon request) gives their (explicit) consent to it pursuant to Article 6(1) point a and Article 9(2) point a of the GDPR.
Applicants have the possibility to create a profile on the karriere.at talent.cloud. In this case, bet-at-home and karriere.at GmbH, Donaupromenade 1, 4020 Linz, Austria (referred to as karriere.at hereafter) shall act as joint controllers for the collection and processing of the applicant’s data in the karriere.at talent.cloud. With respect to the joint data processing, the joint controllers shall determine the purpose and means of data processing together.
In an agreement on joint controllership pursuant to Article 26 of the GDPR, bet-at-home and karriere.at have determined how the respective tasks and responsibilities for data processing are structured and who fulfils which data protection obligations. In particular, it has been determined how the joint controllers can guarantee an appropriate level of protection and the security of those concerned, how duties to provide the information under data protection law can be fulfilled and how data protection incidents are monitored. This also includes ensuring that reporting and notification obligations are fulfilled.
In the case of data being processed by joint controllers, the applicant may exercise their data protection rights against each of the individual controllers. In order to respond to a data request in the best way possible and to maintain data subject rights, the controllers will coordinate with one another as defined in the aforementioned joint controller agreement pursuant to Article 26 of the GDPR.
Otherwise, the data shall only be used within the company and shall not be shared with third parties. The data shall only be accessible to employees in the Human Resources department and shall only be submitted to selected managers.

4. Cookies

We use cookies on our website which are necessary for the website to work properly. We also use cookies to analyse and improve the usage of the website as well as for marketing purposes. By clicking on “Accept all cookies”, the website visitor accepts that cookies from us and from third-party providers (some are based outside of the EU and those countries might not have the same data protection standards as the EU) may be used. 5. Protection of Personal Data

Unfortunately, using the internet to transfer information is not completely secure. bet-at-home takes all possible technical and organisational security measures to protect the personal data of applicants from loss and misuse. However, the complete safety of the data of applicants can never be guaranteed. Each transfer of data is therefore at the applicant’s own risk. After receiving the data, bet-at-home adopts technical and organisational measures to ensure that bet-at-home’s systems are protected against attacks and misuse, and that the applicant’s personal data is protected against loss, incorrect modification, or unauthorised use by third parties. The data provided shall be stored in a secure operating environment which is not accessible to the public.
When transmitting personal data within the corporate group, the encoding of data is carried out using Secure Sockets Layer (SSL) technology. The confidentiality of communication is therefore guaranteed.
bet-at-home hereby indicates that, should the applicant wish to contact bet-at-home outside of the management application system, for example via e-mail, it cannot be guaranteed that the transferred information will be confidential.

6. Right of Access and Data Portability

Following a written request and after appropriate proof of identity has been provided, the applicant shall be informed as to which personal data has been stored by bet-at-home and shall receive this data in a commonly used format. To obtain this information, the applicant must send a request for access to hr.recruiting@bet-at-home.com.

7. Right to Rectification, Restriction and Erasure

After a written request via e-mail and once appropriate proof of identity has been presented, any and all of the applicant’s personal information shall be rectified or erased, or the processing of the data shall be correspondingly restricted.

8. Right to Complain

If the applicant believes that the regulations of the GDPR have been breached, they may lodge a complaint with a regulatory authority.

9. Information for Withdrawal and Objection

The applicant may withdraw their declaration of consent to the processing of their data at any time by sending an e-mail to hr.recruiting@bet-at-home.com. Withdrawing consent does not affect the legitimacy of the processing that takes place until consent is withdrawn due to consent being given initially.
If data is processed for the performance of a task carried out in the public interest or in the exercise of official authority or if bet-at-home refers to the necessity of processing data in order to protect legitimate interest, the applicant may then object to this processing of their data if their interests, rights and freedoms outweigh bet-at-home’s interests worth being protected or the processing does not serve the purpose of the establishment, exercise or defence of legal claims.
